Returns & Complaints Policy
Returns, Cancellation & Complaints Policy
This Returns, Cancellation & Complaints Policy explains your rights as a customer in relation to cancellations, returns, refunds, exchanges and faulty goods when purchasing from everydayfavourites.co.uk.
Nothing in this policy affects or limits your statutory rights under applicable UK consumer law.
Right to Cancel
If you purchase goods from us online as a consumer, you generally have a statutory right to cancel your purchase without giving a reason.
You may exercise this right from the time the contract is entered into. For most orders, the cancellation period ends 14 days after the day on which you, or a person nominated by you other than the carrier, physically receives the goods.
If you order several goods in a single order and they are delivered on different days, the cancellation period generally ends 14 days after the day on which you receive the final item.
How to Notify Us of Cancellation
To exercise your right to cancel, you must clearly inform us of your decision before the cancellation period expires.
You can contact us by email at:
info@everydayfavourites.co.uk
We recommend using the subject line:
Cancellation of Purchase + Order Number
You can also notify us in writing at our business address shown below.
You do not have to provide a reason for cancelling.
You may use the model cancellation form provided in our Terms & Conditions, but use of that form is not compulsory. Any clear statement informing us that you wish to cancel is sufficient.
Returning Items After Cancellation
Once you have informed us that you wish to cancel, you must return the goods without undue delay and no later than 14 days after the day on which you informed us of your cancellation.
The deadline is met if you send the goods before the 14-day return period has expired.
Returns should be sent to:
JaTakEngros
Østergade 2
8870 Langå
Denmark
Email: info@everydayfavourites.co.uk
For an ordinary change-of-mind cancellation, you are responsible for the direct cost of returning the goods where you were informed before purchase that you would be responsible for that cost.
If a product cannot normally be returned by post because of its nature, information about the return cost, or a reasonable estimate of that cost where it cannot be calculated in advance, will be provided before purchase where required by law.
We recommend obtaining and retaining proof that the goods have been sent back.
Different rules apply where goods are faulty, damaged, incorrect or misdescribed. Please see the relevant section below.
Condition of Returned Goods
You may inspect and handle goods to determine their nature, characteristics and functioning in broadly the same way that you would reasonably be able to inspect them in a physical shop.
You are responsible for any reduction in value caused by handling beyond what is reasonably necessary for that purpose.
Where permitted by law, we may make a deduction from your refund to reflect any reduction in value caused by unnecessary or excessive handling.
Opening packaging does not automatically remove your right to cancel unless a specific statutory exception applies.
Please return goods with their original packaging, including any boxes, sleeves, tags and accessories supplied with the item, and pack the return securely. Original packaging is not a condition of your statutory right to cancel, but where goods are returned without it, or where the packaging has been damaged beyond what is necessary to inspect the item, we may make a lawful deduction from your refund to reflect the reduction in value.
Items Excluded from the Right to Cancel
The statutory right to cancel does not apply to certain categories of goods in the circumstances specified by law. These may include:
- Goods made to your specifications or clearly personalised
- Goods which are liable to deteriorate or expire rapidly
- Sealed goods which are not suitable for return for health-protection or hygiene reasons once unsealed after delivery
- Sealed audio recordings, video recordings or computer software once unsealed after delivery
- Goods which become inseparably mixed with other items after delivery
Where an exception applies to a product sold by us, we will provide the relevant information before purchase where required.
Uncollected or Refused Parcels
Simply refusing delivery or failing to collect a parcel does not, by itself, constitute a clear notification that you wish to exercise your statutory right to cancel.
You should also contact us at info@everydayfavourites.co.uk and clearly state that you wish to cancel.
If you have already informed us that you are cancelling and the parcel has been dispatched, please follow any reasonable return instructions we provide.
Where you exercise your statutory cancellation right and are responsible for the direct cost of returning the goods, that responsibility also applies where the goods are returned following refusal or non-collection, to the extent permitted by law.
We do not impose arbitrary cancellation, restocking, handling or administration charges for exercising your statutory right to cancel.
If a parcel cannot be delivered because you supplied an incorrect or incomplete address, or because you failed to collect it without exercising your cancellation right, we may require payment of the reasonable direct cost of re-delivery if you ask us to send the order again.
Refunds Following Cancellation
If you validly exercise your statutory right to cancel, we will refund the payments received from you for the cancelled goods.
Where required by law, this will also include the cost of the least expensive standard delivery method that we offered for the order.
If you selected a more expensive delivery method, we are not required to refund the additional amount above the cost of our least expensive standard delivery option.
If goods have been supplied to you, we may withhold the refund until:
- we have received the goods back; or
- you provide evidence that you have sent the goods back,
whichever happens first.
We will then make the refund without undue delay and no later than 14 days after the applicable date.
If the goods have not been supplied to you, the refund will be made without undue delay and no later than 14 days after the day on which you informed us of your decision to cancel.
Refunds will normally be made using the same payment method used for the original transaction unless you expressly agree otherwise.
You will not be charged a fee for receiving the statutory refund.
Where permitted by law, we may deduct an appropriate amount for diminished value caused by handling beyond what was necessary to establish the nature, characteristics and functioning of the goods.
Exchanges
We may offer voluntary exchanges in addition to your statutory rights.
If you would like to request an exchange, please contact us at:
info@everydayfavourites.co.uk
We recommend using the subject line:
Exchange + Order Number
Please tell us which item you wish to exchange and which item you would like instead.
For a voluntary exchange requested solely because you have changed your mind, you may be responsible for reasonable return and re-delivery costs.
Voluntary exchanges are offered at our discretion and require the item to be returned unused and complete in its original packaging.
This does not apply where an exchange, repair, replacement or other remedy is required because goods are faulty, damaged, incorrect, misdescribed or otherwise do not conform to the contract.
Faulty, Damaged, Incorrect or Misdescribed Goods
Your statutory rights relating to faulty or non-conforming goods are separate from your 14-day cancellation right.
Under the Consumer Rights Act 2015, goods supplied to consumers must generally be of satisfactory quality, fit for purpose and as described.
If goods do not meet the requirements of the Consumer Rights Act 2015, you may be entitled to statutory remedies.
Depending on the circumstances, these can include:
- A short-term right to reject the goods and receive a refund, generally available during the first 30 days where the statutory requirements are met
- Repair or replacement
- A reduction in price
- A final right to reject the goods and receive a refund where the statutory requirements are met
If you request a repair or replacement in circumstances covered by the Consumer Rights Act 2015, it must be carried out within a reasonable time and without significant inconvenience to you.
Where the law requires us to repair, replace or accept the return of faulty or non-conforming goods, we will bear the necessary or reasonable return costs as required by law.
If a product arrives damaged, is faulty, is incorrect or materially differs from its description, please contact us at:
info@everydayfavourites.co.uk
Please provide, where reasonably possible:
- Your order number
- A brief description of the problem
- Photographs showing the fault or damage
- Photographs of the packaging where relevant
Providing photographs can help us investigate and resolve the matter more quickly. A request for photographs does not remove or restrict your statutory consumer rights.
Warranties and Statutory Rights
Any manufacturer’s warranty or commercial guarantee supplied with a product is additional to, and does not replace or restrict, your statutory rights.
Your statutory rights may continue to apply even if a manufacturer’s or commercial warranty has expired.
Damage caused by misuse, accidental damage, inappropriate handling or ordinary wear and tear will not normally amount to a breach of the statutory requirements relating to the quality of goods merely because such damage has occurred.
No Return or Processing Fees
We do not charge restocking fees, handling fees or processing fees simply because you validly exercise your statutory right to cancel or exercise your statutory rights in relation to faulty goods.
This does not prevent you from being responsible for direct return costs following a change-of-mind cancellation where the law permits this and you were properly informed of that responsibility before purchase.
Complaints
If you have a complaint regarding an order, product, return, refund or our service, please contact us at:
info@everydayfavourites.co.uk
Please include your order number where applicable and sufficient information for us to investigate the matter.
We will try to resolve complaints fairly and within a reasonable period.
If a complaint cannot be resolved through our internal complaints procedure, we will provide information about any Alternative Dispute Resolution or other complaint-resolution arrangements in which we are required to participate, where applicable.
Nothing in this complaints procedure prevents you from exercising your statutory rights or bringing a claim before a court with jurisdiction.
